These Terms of Service ("Terms") govern your use of breedscout.com and related services (the "Service"), operated by Luistro Enterprises LLC ("BreedScout," "we," "us," or "our"). By using the Service, you agree to these Terms.
Accounts
You must create an account to list, discover, or message about dogs on BreedScout. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You must be 18 years of age or older to create an account or use the Service.
The BreedScout platform
BreedScout is a platform for listing, discovering, and communicating about dogs available for breeding or purchase. BreedScout is not a party to, and assumes no responsibility for, any transaction between users. BreedScout does not process payments, take possession of any animal, or broker sales; all transactions occur directly between breeders and buyers, off-platform.
Breeder responsibilities
The breeder is solely responsible for the sale, including compliance with all applicable federal, state, and local laws, including USDA/APHIS licensing requirements where applicable (for example, federal licensing is generally required for breeders with more than four breeding females who sell dogs sight-unseen or online), and for any warranties, disclosures, or remedies owed to a buyer under applicable law.
Acceptable use
You agree to use the Service only for lawful purposes and in accordance with our Community Guidelines. You may not use the Service to misrepresent a dog's health, genetics, or provenance, or to circumvent any applicable licensing requirement.
Content and ownership
You retain ownership of the photos, health records, and other content you upload to BreedScout. By uploading content, you grant BreedScout a license to display that content on the Service for the purpose of operating the platform. BreedScout does not claim ownership of user-submitted content.
Disclaimers
The Service is provided "as is" without warranties of any kind. BreedScout does not verify the accuracy of listings, health claims, or user representations, and disclaims any responsibility for the condition, health, or provenance of any animal listed on the Service.
Limitation of liability
To the fullest extent permitted by law, BreedScout and Luistro Enterprises LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service or any transaction between users.
Termination
We may suspend or terminate your account if you violate these Terms or our Community Guidelines.
Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles.
Dispute resolution
Any dispute arising from these Terms or the Service will be resolved through binding arbitration on an individual basis, and not as a class or representative action. These Terms are governed by Arizona law, and Arizona will be the venue for any matter not subject to arbitration.
